Conditions of Sale

• Names, descriptions, symbols and numbers being quoted or appearing on invoice are used for the internal reference purposes of A & D Motors Pty Ltd only, and it is not implied that the parts supplied are the actual manufacturers whose part numbers may be quoted.
• All Prices are "ex warehouse". Liability for transport charges and/or transport insurance of purchased goods will be the purchaser's responsibility regardless of whoever organised the arrangements, such charges not refundable where included in the purchase price in any event where the goods are later returned for credit. Regardless of whether A & D Motors Pty Ltd has organised and/or charged the purchaser for the freight, goods which become damaged or lost in transit or delivered later than expected will not be covered, re-supplied, replaced or repaired by A & D Motors Pty Ltd regardless of circumstance, such matters are to remain between the freight company and the purchaser and, A & D Motors Pty Ltd does not accept responsibility or liability for unfavourable outcomes.
• A & D Motors Pty Ltd cannot be held responsible for any verbal or implied representations made by any of its employees or agents with regard to warranties, returns, suitability and performance of goods outside of the actual written invoice description of the goods sold and, the actual warranty term schedule applicable to the goods sold.
• Until payment has been made for the goods listed on the invoice, the property and title of those goods remains with A & D Motors Pty Ltd.

Goods returned for credit or refund

• CASH REFUNDS WILL NOT BE GIVEN.
• No refunds or credit will be given on any electrical items, second hand parts, engines, gearboxes cabins, diffs whether they be new, reconditioned or second hand.
• New Parts returned (in an acceptable condition) within 30 days of invoice date may be exchanged or credited only at the discretion of the management of A & D Motors Pty Ltd, and all returns will be subject to a minimum handling charge of 10%.
• No credit, exchange or refund will be allowed on New Parts returned after 30 days from the date of invoice.
• Freight charges for returns MUST be prepaid by purchaser. Freight forward will not be accepted, such charges are the responsibility of the purchaser. Freight and delivery fees will not be credited under any circumstance.
• Where A & D Motors Pty Ltd signs for the receipt of returned goods delivered to our stores, such signature does not signify acceptance that any credit or refund will be given. The onus remains entirely upon the sender of any goods being returned for credit to ensure the correct A & D Motors Pty Ltd employee is fore advised of the goods being returned and given a follow up phone call to confirm that the goods have arrived at A & D Motors Pty Ltd stores within the expected delivery time. Goods returned without prior warning or follow up may become misplaced in transit or within A & D Motors Pty Ltd Stores, and such losses are to remain the responsibility of the purchaser at all times.
• Incomplete part kit sets such as gasket kits, ring sets and packs, bearing sets/packs piston/liner kits etc will not be accepted for credit under any circumstance. The onus is upon the purchaser to ensure all goods supplied are both correct and suitable for the job and any items or packaging which become damaged, shop soiled or lost in the checking process remain the responsibility of the purchaser at all times.
• Engine kits. All Engine kits are priced, packaged and sold as a complete kit set and no separate component/s may be returned for credit under any circumstance.
• All returned goods MUST be in the original packaging accompanied by original invoice and in a condition suitable for our re-stocking and, re sale. Any New Parts returned in damaged, greasy/dirty hand marked shop soiled packaging will not be allowed for credit under any circumstance. It is the purchaser's responsibility to ensure all goods supplied are suitable prior to fitment and where handling is unavoidable in the checking process the packaging and items must be handled in an appropriate fashion so shop soiling and/or damage is avoided. Bearings and rings must be in an unopened condition.
• Special Procurements (Buy Ins) will not be accepted for credit or refund regardless of circumstance.

Services, Advice and Literature of A & D Motors Pty Ltd
Any advice, service or literature which may be offered by A & D Motors Pty Ltd is rendered in all good faith and A & D Motors Pty Ltd shall not be liable for any loss or damage arising therefrom.

Jurisdiction, Payment and Non-Payment Consequences
1) The contract shall be construed according to the Law of the State of New South Wales of the Commonwealth of Australia which shall be the proper law of the contract. The parties accept the jurisdiction of the courts of the State/or the New South Wales Registry of any relevant Federal court or governing body of Australia.

• Where credit has been extended by A & D Motors Pty Ltd, if the purchaser does not pay for the goods on the due date then A & D Motors Pty Ltd is hereby irrevocably authorised by the purchaser to enter the purchasers premises (or any premises under the control of the customer or agent of the purchaser in which the goods are stored at such premises) and use reasonable force to take possession of the goods without liability of the tort of trespass, negligence or payment of any compensation to the purchaser whatsoever.
• On retaking possession of the goods A & D Motors Pty Ltd may elect to refund to the purchaser any part payment that may have been made and to credit the purchasers account (where applicable) the value of the goods less any charge for the recovery of the goods, or to re-sell the goods.
• The applicant (that is the purchaser that has not paid) shall indemnify A & D Motors Pty Ltd for costs, fees, commission charges and disbursements charged by any mercantile agent or solicitor engaged for the purpose of the collection or recovery of moneys due and payable to A & D Motors Pty Ltd.

Warranty Policy * Denotes whichever comes first

Note: Any Engine, gearbox, differential, component or part which is used in a high performance application or, is modified to obtain additional power or subjected to conditions beyond the manufacturer's standard (aftermarket turbo charger fitted to Naturally Aspirated engine etc) will immediately void warranty.

• Specific Terms and conditions apply to all warranties offered (refer to warranty card and invoice applicable to the goods being supplied/sold)
• All Warranties commence from the date of invoice, Normal wear and tear is not warrantable.
• In the event of a warranty claim it is the purchaser's responsibility to contact A & D Motors Pty Ltd Customer Service Department prior to any rectification or incursion of costs.

• A & D Motors Pty Ltd will not be held responsible for unauthorised repairs, diagnosis time, freight, towing, hire vehicles, loss of profits, consequential loss or damage.
• New, Reconditioned, and Used Parts Warranties are limited to the replacement or repair of goods sold and which have been deemed warrantable by A & D Motors Pty Ltd, the manufacturer or agent. Labour charges and any other expenses associated to consequential losses or damage remains the purchaser's responsibility at all times.

• All New Parts sold are subject to the limitations of the manufacturers' warranties and also State Consumer Laws.
• No warranty claim will be considered without the full examination of parts claimed to be defective along with any associated parts deemed necessary to make a proper and accurate diagnosis.

• No warranty on electrical goods or items.
